Terms of Service

These Terms of Service govern your use of the Cape Code Studios website and the services we provide. By engaging our services or using this website, you agree to be bound by these terms. Please read them carefully.

1. About Cape Code Studios

Cape Code Studios is a web design and digital marketing agency based in Cape Town, South Africa. We provide website design and development, SEO, digital marketing, AI integrations and related services to businesses and individuals.

2. Services and Deliverables

The specific services, deliverables, timelines and pricing for each project are confirmed via written agreement, quote or invoice prior to commencement. Cape Code Studios will make every reasonable effort to deliver services as described and within the agreed timeframe. Delivery timelines are estimates and may be affected by client response times, content provision and revision requests.

3. Payment Terms

• All once-off projects require a 50% deposit before work commences, with the remaining balance due upon completion before the final handover or go-live.
• Monthly retainer services are billed in advance at the start of each billing cycle.
• Payment is accepted via EFT or bank transfer. Invoices are due within 3 business days unless otherwise agreed.
• Failure to pay may result in suspension of services or withholding of deliverables.
• All prices are quoted and invoiced in South African Rand (ZAR) and are VAT exclusive unless stated otherwise.

4. Revisions and Changes

Each project includes a defined number of revision rounds as specified in your package. Additional revisions beyond the included allowance will be quoted and charged separately. Requests for significant changes to scope after work has commenced may require a revised quote.

5. Client Responsibilities

The client agrees to:

• Provide all required content, images, branding assets and information in a timely manner
• Respond to review requests and feedback rounds within a reasonable time (typically 3 business days)
• Ensure all content and materials provided do not infringe on any third-party intellectual property rights
• Provide accurate business information for use in website content and SEO

Delays caused by the client's failure to provide required information or feedback may affect delivery timelines without penalty to Cape Code Studios.

6. Intellectual Property

Upon receipt of full payment, the client is granted full ownership of the final website design and content created specifically for their project. Cape Code Studios retains the right to showcase completed work in our portfolio unless the client requests otherwise in writing. Third-party assets (stock images, fonts, plugins) remain subject to their respective licence terms.

7. Hosting and Domain

Unless otherwise specified, Cape Code Studios does not provide hosting or domain registration services. The client is responsible for maintaining their own hosting and domain. Cape Code Studios will assist with deployment but is not liable for third-party hosting performance, downtime or data loss.

8. Satisfaction Guarantee

If you are not satisfied with the initial design concept, Cape Code Studios will provide one complimentary redesign. This guarantee applies to the initial design concept and does not cover scope changes, additional pages or features not included in the original agreement.

9. Limitation of Liability

Cape Code Studios will not be liable for any indirect, incidental or consequential damages arising from the use of our services, including lost revenue, data loss or business interruption. Our total liability is limited to the amount paid for the specific service in question.

10. Termination

Either party may terminate a project with written notice. In the event of client-initiated termination, the deposit paid is non-refundable. Work completed up to the point of termination will be invoiced at a pro-rata rate based on the agreed project price.

11. Governing Law

These Terms of Service are governed by the laws of the Republic of South Africa. Any disputes will be resolved in accordance with South African law.

12. Changes to These Terms

We reserve the right to update these terms at any time. Continued use of our services after any changes constitutes acceptance of the revised terms. We will notify active clients of any material changes.
